{"id":1955,"date":"2015-11-18T19:35:35","date_gmt":"2015-11-18T19:35:35","guid":{"rendered":"https:\/\/gillespieinsuranceservices.com\/?p=1955"},"modified":"2015-11-18T19:35:35","modified_gmt":"2015-11-18T19:35:35","slug":"how-to-insure-a-winery-part-1","status":"publish","type":"post","link":"https:\/\/finfrockweb.com\/gis\/business-insurance\/how-to-insure-a-winery-part-1\/","title":{"rendered":"How To Insure A Winery &#8211; Part 1"},"content":{"rendered":"<h4>There is something magical that results when grapes sit and do nothing: they turn to wine. \u00a0The environment and conditions have to be just right, but with enough time, grapes become wine by\u00a0virtue\u00a0of sitting still.<\/h4>\n<p><!--more--><\/p>\n<p>Those who make the wine, on the other hand, are anything but still. \u00a0The winery business is difficult, and those that enter into it must have a complimentary blend of patience and hustle, as well as the ability to face the risks involved.<\/p>\n<p>Every business must deal with risk, but a\u00a0winery is a different kind of business, blending farming, manufacturing, often restauranting and even tourism. \u00a0It has a unique set of risks. \u00a0Because of this, it is to the\u00a0wine maker&#8217;s\u00a0benefit that he or she takes the time to find a proper insurance plan. \u00a0But what does that mean? What is a proper insurance plan?<\/p>\n<p>First, it&#8217;s important to know what we&#8217;re actually able to insure\u00a0when we insure a business, any business. \u00a0The fact is many things &#8211; most things &#8211; in the wide world of what could possibly go wrong\u00a0are not insurable. \u00a0 (For more on what&#8217;s not insurable, please check out my <a href=\"https:\/\/gillespieinsuranceservices.com\/what-is-insurable-and-what-isnt\/\">previous blog post<\/a>). But of those things that <strong>are<\/strong> insurable, \u00a0a solid insurance plan will cover them. \u00a0Those insurable things &#8211; that a proper insurance plan will cover &#8211; fall into two categories:<\/p>\n<ol>\n<li>Liability<\/li>\n<li>Property<\/li>\n<\/ol>\n<p>Let&#8217;s talk about\u00a0Liability and what it means.<\/p>\n<p>Liability means YOUR liability to OTHERS. \u00a0 It is Bodily Injury or Property Damage to OTHERS that YOU are responsible for because of your negligence. \u00a0What could you be held liable for? \u00a0Here are a few examples.<\/p>\n<ul>\n<li>A patron checking out your tasting room\u00a0slips and falls on your steps, sprains her\u00a0ankle, \u00a0knocks her head on the ground giving her a concussion&#8230; and cracks her iPhone screen.<\/li>\n<li>A wine-club patron loses his grip on his newly purchased bottle of your wine. \u00a0It falls to the ground, smashing his toe and spraying glass shards into his shin. \u00a0He claims it happened because the label came loose.<\/li>\n<li>After leaving your restaurant or tasting room, a patron drives through a red light, hits and kills a pedestrian and gets charged with a DUI. \u00a0You are sued for serving that patron too much wine.<\/li>\n<li>You store your wine at a leased location and the owner of that property requires that you cover him if anyone gets hurt or damages their property on his premise because of your actions.<\/li>\n<li>You&#8217;re on your tractor, crossing the road in between your two vineyards, and a car comes out of nowhere\u00a0and hits you, \u00a0and later sues you for the back injuries sustained.<\/li>\n<\/ul>\n<p>Note: you don&#8217;t have to actually be negligent to have a\u00a0bodily injury or property damage claim cost you money. \u00a0Just being accused of a wrongdoing means that you have to pay a lawyer to defend you, and the cost to prove your innocence is often as much as it would have cost if you were actually held liable and settled in the first place.<\/p>\n<p>As you can see, there are a lot\u00a0of things that can go wrong resulting in bodily injury and property damage at your winery that you could be held liable for. \u00a0What then is the proper type of insurance to pay for these incidents? \u00a0The answer is: Commercial General Liability insurance.<\/p>\n<p><strong>Commercial General Liability (CGL) insurance pays for bodily injury and property damage your winery business is held liable for, or merely accused of being held liable for.<\/strong><\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignright wp-image-1995 size-full\" src=\"https:\/\/gillespieinsuranceservices.com\/wp-content\/uploads\/2015\/11\/Pers-Injury-Text-Box.png\" alt=\"Pers Injury Text Box\" width=\"270\" height=\"270\" \/>The CGL policy\u00a0starts with a big promise &#8211; it will pay if you are liable. \u00a0It then goes and lists some of the things it won&#8217;t pay for. \u00a0That list is called the Exclusions. \u00a0In order to avoid a long academic post that only insurance geeks like me would be interested in, I&#8217;m going to cut to the chase. \u00a0There is a big exclusion that a winery must pay attention to &#8211; the Liquor Liability exclusion.<\/p>\n<p>The Liquor Liability exclusion states that if you are in the business of manufacturing, selling, and\/or serving alcohol (and you are!), the liability arising out of your alcohol does not apply.<\/p>\n<p>The good news is there is a fix for this gap: Liquor Liability insurance. \u00a0Most of the time Liquor Liability insurance can be included on the same package of coverages\/policies from the company insuring your winery. \u00a0If not, it can be purchased as a standalone policy. \u00a0(It usually costs less if it&#8217;s included on the package). \u00a0Either way, Liquor Liability insurance will fill the gap from the exclusion referenced above. \u00a0A winery absolutely always need Liquor Liability insurance &#8211; so make sure you have it!<\/p>\n<p>Wrapping up this section; a proper insurance plan will cover the liability and property risks\u00a0that your winery faces. \u00a0A CGL and Liquor Liability are critical components to insuring the liability portion of your winery.<\/p>\n<p>Now what about the other insurable risk\u00a0&#8211; Property?
